EDITOR’S NOTE

NEW YORK CITY’S HIGH LINE was built 90 years ago as an elevated railroad delivering goods and supplies to the west side of lower Manhattan. At its peak, it came to be known as the “Life Line of New York,” according to the nonprofit that maintains the structure now as a park. It deserves that name again, but this time for linking Hudson Yards to a steady supply of visitors walking up from lower Manhattan.

COVID-19 sidelined Hudson Yards, a subsidized, mixed-use private development billed as the largest in U.S. history and costing $25 billion. Its observation deck, “Edge,” tempo rarily closed after only being open for two days because of the citywide shutdown caused by the pandemic in March 2020. Neiman Marcus later closed as the retailer sought bank ruptcy protection. Rent collections declined and condo sales slowed. Adding insult to injury, the Vessel, Hudson Yards’ public art centerpiece spiraling up 16 stories, closed after four people jumped off the structure and died by suicide.

Enter the High Line. This unique urban space extending about 1.5 miles to the south of Hudson Yards not only brings visitors there, it connects this isolated neighborhood with Chelsea, the Meatpacking District and Greenwich Village. The High Line brings both tourists and New York residents to the development, aiding in its recovery which made progress last week with the opening of 50 Hudson Yards. The $3.8 billion office building is 84% preleased. That follows a news report that the development’s already existing office space was 95% leased or sold as of August. Surely, many of those office workers will want to take a walk on the High Line.

COVID-19 cases, and test positivity rates are start ing to increase in some areas of New York City. According to city data, neighborhoods including Manhattan’s Hell’s Kitch en, Brooklyn’s East New York, Queens’ Richmond Hill and Staten Island’s Great Kills had seven-day positivity rates of more than 15%. The Centers for Disease Control and Prevention warned of two new variants: BQ.1 and BQ.1.1, which now make up 16% of cases nationwide. At the same time, the newest omicron booster, which was made available beginning in September, has not been very popular. Only about 363,000 New Yorkers had received the new shots as of Oct. 12.

lized apartments continues to shrink. The City reported there were 927,753 units in 2019, and that was down to 857,791 in 2021.

INNOVATION QNS FIGHT

A proposed Queens housing complex is the latest in a long line of developments to face opposition from the local New York City Council member. The Innovation QNS development would be huge, transforming whole city blocks currently used for parking and large retail stores in Astoria with 12 new towers and about 3,000 new apartments. Council Mem ber Julie Won said she won’t support it because there weren’t enough affordable units included in the plan, even after the developers promised to make 40% of the apartments affordable.

The proposal has support from Adams and Queens Borough President Donovan Richards, and Richards and Won debated the issue at a testy City Council hearing on Oct. 19 following dueling rallies.

A PODCAST IS BORN

Former Gov. Andrew Cuomo, climbing back into the public eye with his characteristic determination, dropped the first episode of his new podcast “As A Matter Of Fact … .” Cuomo, who resigned in 2021 after multiple former staffers accused him of sex ual harassment, interviewed former Trump Communica tions Director Anthony Scar amucci. The former governor and the ill-fated presidential spokesperson, neither of whom is currently in public service, lamented political polarization and gridlock.

State Senate Dems could add two more women of color

In 2020, when state Sen. Samra Brouk won her Roch ester area seat, she became the first upstate woman of color in the state Sen ate. She joined the only two other women of color north of Westchester in the entire Legislature, forming a tiny contingent of three. But that number may soon expand if Democrats Julie Shiroishi in the Hudson Valley and Lea Webb in the Southern Tier emerge victorious on Nov. 8.

Shiroishi, if elected, would join what seems to be a slow ly growing trend of upstate women of color running for office, she would make histo ry in her own right as the first Japanese American state law maker. “I don’t look like most of the people – any of the people – who have represent ed this district or really run for office in this area,” Shi roishi told City & State, who is running to represent the 39th District in and around Poughkeepsie. “But that’s why I thought it was import ant.” Shiroishi is running against Poughkeepsie Mayor Robert Rolison, a white Re publican. “I’m aware of my identity; it’s not the only reason that I’m running,” Shiroishi said, noting that the Hudson Valley doesn’t have a large community of Asian

Americans. “I want people to focus on my issues and my experience, but … I think it’s important to have people from a range of backgrounds involved in making the deci sions that affect our lives.”

For Shiroishi, that back ground includes growing up in an immigrant family – her mother born in Japan and her father Japanese Amer ican. Her father, a union member and truck driver, had been interned during World War II when he and his family lived in California.

Unlike first-time candi date Shiroishi, Webb comes into her state Senate race having served two terms as a Binghamton City Council member. At the age of 26, when voters first elected her, she was already aware that she was a shift away from the area’s typical represen tative. “One of the things that pushed me to (run), which was a barrier, was the lack of diverse represen tation,” Webb told City & State. “I didn’t see any folks of color, very limited repre sentation from a gender or gender diversity standpoint.” She feels similarly about her campaign for the 52nd District against Bingham ton Mayor Richard David.

Define ‘striking distance’

APAIR OF newly released polls paint very different pictures of the state of the race for governor in New York. Numbers out of Siena College have Gov. Kathy Hochul leading Rep. Lee Zeldin by 11 per centage points. Meanwhile, a poll from Quinnipiac University found a much narrower margin of victory, giving the in cumbent Democrat just a 4 percentage point lead. That’s a stark difference between two polls put out on the same day. But neither poll alone tells the whole story of what’s happen ing in the race for governor.

The Quinnipiac poll shocked political ob servers when it came out given that it pre dicted the closest outcome of any major public polling of the race so far. What’s more, it found 37% of New York City voters backed Zeldin, well above the 30% thresh old in the deep-blue city viewed by the GOP as necessary for statewide victory. And while the 11 percentage point lead the Siena poll gave Hochul still represents a comfort able margin of victory for the governor, it would be the closest in decades. And it’s a significant decrease compared to the Siena poll from last month, which had her up by 17 percentage points.

Both new polls were conducted after a high-profile shooting that occurred outside of Zeldin’s Long Island home and left two teens injured. Political observers aren’t necessarily surprised to see the gap between Hochul and Zeldin closing, with a Marist College poll from earlier this month showing a 10-point difference that seems in line with the new Siena poll. But the situation for Democrats may not be as dire as the Quinnipiac poll may suggest. “I don’t dispute that the likelihood is

that Zeldin has tightened the race from a month ago,” Bruce Gyory, a lobbyist with Manatt, told City & State. “But that it’s down to 4%?” He pointed out the difference in sample groups between the Siena and Quin nipiac polls, with the latter including fewer Democrats. The Quinnipiac sample would indicate a lower-than-average turnout from voters on the left, whereas the Siena sample group was more in line with recent electoral trends. “That leaves me a little suspicious,” Gyory said, noting that Quinnipiac infa mously released a poll that showed Carl Pala dino only 6 percentage points behind former Gov. Andrew Cuomo in 2010. Cuomo won his first term that year in a landslide.

Despite the wonky polling science that might leave one to question the Quinnipiac poll, it and other recent surveys still reveal

a trend that Hochul would do well to take seriously. “Polls always tighten,” Camille Rivera, a Democratic consultant with New Deal Strategies, told City & State. “It does however show that (Hochul) needs to amp (up) her ground game and crime is what is moving the numbers unfortunately.” The Quinnipiac poll found crime to be the top issue for likely voters in New York, with inflation second on the list. That, however, differs from both the recent Marist poll and the Siena poll from last month, which both had inflation as the biggest concern, fol lowed by threats to democracy.

What has become apparent is that abor tion rights, which Hochul has made a cor nerstone of her campaign, is not a major motivating factor for voters. That has been consistent across public polling so far. “The

problem looks like choice has not been the silver bullet among suburban women,” Jake Dilemani, a Democratic consultant with Mercury, told City & State. And it benefits the right to have inflation at the top of vot ers’ minds. “Historically, in the modern era, voters have ascribed better performances to Republicans than Democrats on crime and the economy,” Dilemani said. “And (those) issues are the two most salient.”

The Hochul campaign responded to the new polling in a statement sent to reporters. “Despite $8 million in outside spending from right-wing groups pushing baseless lies, Governor Hochul maintains a double-dig it lead against her opponent,” campaign spokesperson Jerrel Harvey wrote. “Even in today’s Quinnipiac poll, which substantially undercounted Democrats, Governor Hochul continues to receive support from fifty per cent of New Yorkers and we are confident in our ability to turn out voters in every com munity.” At an event on Oct. 18, Hochul told reporters that she wasn’t paying attention to the poll numbers and that she approaches every race as if she were “the underdog.”

But more than anything else, the new polls and the changes from just a month ago suggest that the race is far from over, even if new numbers have begun to turn more in Zeldin’s favor. Just as the decision to over turn Roe v. Wade threw a wrench in Repub lican electoral politics across the country in the months that followed, another major de velopment could steer the race for governor in yet another direction. “I think this race is teetering between being a comfortable double-digit win … for Hochul, or drop ping down to a closer race in the 5% range,” Gyory said. ■

ALL EYES ARE on New York state when it comes to control of the House of Representatives, with as many as 10 competitive races out of the state’s 26 seats. And with Democrats holding a slim, eight-vote majority this session, every election could count.

But even the most attention-hungry New York Democrats might not be happy about the state’s turn in the spotlight (here’s looking at you, Sean Patrick Maloney). Congressional district maps passed into law by New York’s Democratic Leg islature and governor were gerrymandered to help Democrats and hurt Republicans. Long story short, the maps got tossed by the courts, and the new district lines prioritized competitiveness –which was good news for conservatives. The op position party usually sees major gains in the first midterm election of a president’s tenure.

That redistricting process, tied to the 2020 cen sus, left the state with 26 seats, down from 27, and placed a lot of New Yorkers in substantially redrawn districts. City & State looked at every district in the state to preview the general elec tion, and these are the Top 10 races to watch.

WHAT’S HAPPENING: Suffolk County Legislature Chief of Staff Nick LaLota was the party establishment’s pick in the Republican primary. He got 47% in the three-way race so he’s got some ground to make up on a Democrat he must know well from his government job: Suffolk County Legislator Bridget Fleming, who was able to avoid a primary. But don’t be fooled by Biden’s narrow advantage here – this is a Republican-leaning district, with the county GOP fully expecting to hold on to the seat despite Rep. Lee Zeldin leaving office to run for governor. In fact, his coattails could carry LaLota, a Navy veteran who was a 2016 Republican National Convention delegate for Donald Trump, to victory. While the candidates are predictably far apart on abortion, policing has become a hot topic. LaLota’s side has criticized Fleming for saying racial injustice was widespread in government and law enforcement. Fleming’s side has attacked LaLota for pitching the idea of cutting police funding when he served on the Amityville village board. Fleming, a former Manhattan prosecutor, might have earned a surprising endorsement from the county’s police union because of her former role. Most prognosticators rate the seat as leaning Republican.

WHAT’S HAPPENING: It’s a rare 2020 rematch. But the seat is no longer open – Rep. Andrew Garbarino has two years under his belt and a reputation as a moderate Republican. The incumbent has greatly outraised and outspent Jackie Gordon, an Army veteran and school guidance counselor, and the Democrat isn’t getting much if any outside help from super PACs, which have largely written off the race. Still, anything could happen if voters are moved by her appeals on abortion rights and gun control over Garbarino’s talk of inflation and crime. Most House raters consider this one as likely Republican, or at least leaning Republican.

WHAT’S HAPPENING: Public relations maven Robert Zimmerman pulled off a big win in the crowded Democratic primary as the party establishment’s choice, thanks in part to his decades of support for the Democratic National Committee.

Investment banker George Santos is a MAGA loyalist who once said he paid for legal support for Jan. 6 rioters. He’s a hardliner on abortion, and those views may be enough to sink him in the wealthy, suburban district – even as he tries to focus his campaign on crime and inflation. But in a potential wave year for Republicans, Santos has a much better shot than he did in 2020, when he ran against then-incumbent Rep. Tom Suozzi. Zimmerman and Santos’ fundraising is almost even, though the Democrat has attracted some outside super PAC support, primarily from 1199SEIU. Both candidates are out gay, which may be the first time that’s happened in a race for the House.

4TH CONGRESSIONAL DISTRICT

WHAT’S HAPPENING: Long Island’s House seats are turning over, and Rep. Kathleen Rice is retiring from Congress too. This should be a safe Democratic district – a Republican hasn’t won this South Shore seat since 1996 – but Republican Anthony D’Esposito has some party faithful feeling hopeful, especially following conservatives’ wins in recent races for county executive, district attorney and more. Democrat Laura Gillen was a casualty there, losing her reelection bid for Hempstead supervisor in 2019. Both candidates are about even in fundraising, and neither are getting outside support in the general – after a super PAC funded by the cryptocurrency industry spent $250,000 backing Gillen in her Democratic primary win.

CANDIDATE MIKE ITKIS ISN’T GOING TO BEAT JERRY NADLER, BUT HE GOT EVERYONE TALKING.

Itkis’ platform of sex positivity raised some eyebrows due to his explicit video.

IN A GRUNT for attention, third-par ty congressional candidate Mike Itkis has released a sex tape to highlight his sex positive campaign platform. The 53-year-old Army cyber operations of ficer is bound to lose to Rep. Jerry Nadler in Manhattan’s 12th Congressional Dis trict. But he posted the 13-minute video to a popular online porn site of him having sex with porn performer Nicole Sage as “a conversation piece,” he told City & State.

“If I would just talk about it, it wouldn’t demonstrate my commitment to the issue. And the fact I actually did it was a huge learning experience, and it actually influ enced items on my platform.” His issues include legalizing sex work and making sexual rights explicit – “do NOT rely on privacy or free speech rights,” his cam paign site reads, where sex positivity is one of just three campaign issues, which are all thin on details. Itkis, whose bio identifies himself as – “Not married. No kids. Not celibate. Atheist.” – also seems to take aim at child support payments, writing that “men should not be required

to support biological children without prior agreement.”

Itkis said the video “Bucket List Bonan za” in 2021 was his first time having sex on camera, and he insisted he’s not an exhibi tionist. “I’m very much an introvert,” the “very liberal” registered Democrat said. “I’m kind of a nerd who doesn’t like to be the center of attention if I can avoid it. But I thought the issues I’m trying to address are so important. … I wanted to have my issues talked about in some way.”

Sex tapes may be becoming a political trend on the Upper West Side. In 2021, New York City Council candidate Zack Weiner leaked a BDSM sex tape in an ap parent attempt to stir up drama for his mockumentary on the run. (Editor’s note: Coltin was interviewed for the film, which is ex pected to be released next year.)

The Nadler campaign declined to com ment. Itkis’ Republican opponent under stood it. “You gotta do what you gotta do,” Mike Zumbluskas told City & State. “The media ignores everybody that’s not a Dem ocrat in the city.”

FROM THE MILITARY TO CONGRESS

NEARLY 200 VETERANS are run ning for Congress across the coun try this year, and a dozen of them are in New York. Six Democrats and six Republicans who served are running this year from Long Island to Buf falo, including in some of the state’s most competitive districts. In two races, both candidates are running on records of mil itary service.

The U.S. military has a reputation for leaning conservative, and most of the can didates running as veterans across the country this year are Republican – in cluding some on the far right. A record of service can help distinguish candidates to voters, and Democrats have found some success in running veterans who can ap peal to swing voters. But posting a picture of a candidate in uniform on their cam paign website won’t cut it. “You can’t just stand up there and say, ‘I’m a veteran, vote for me.’ That will appeal to a few people, but not as many as you need,” Grant Ree her, director of the Campbell Public Af fairs Institute at Syracuse University, told City & State in a recent interview about the race in the 22nd District, where two vet erans are running. “You’ve got to be able to articulate a connection between what you’ve done as a veteran, and how that’s going to make you a better representative.”

Here are the veterans running for Con gress in New York this year.

FRANCIS CONOLE

(22ND DISTRICT, DEMOCRAT)

Like his opponent in Central New York’s 22nd District, Democrat Francis Conole is also a Navy veteran. Conole was deployed to Iraq in 2010 and has more recently worked as an adviser on U.S. defense pol icy. He is currently in the Navy Reserves.

(23RD DISTRICT, DEMOCRAT)

Democrat Max Della Pia, running a long shot race in a safely Republican district, is an Air Force veteran.

(2ND DISTRICT, DEMOCRAT)

Democrat Jackie Gordon is taking her sec ond shot at one of Long Island’s purple seats after losing to Rep. Andrew Garba rino in 2020. Gordon has led with her ser vice in the Army Reserves on the campaign trail, having deployed to Iraq and Afghan istan as well as serving as an operations of ficer at Guantanamo Bay, according to her campaign website.

(11TH DISTRICT, DEMOCRAT)

Democrat Max Rose served just two years in Congress representing Staten Island and southern Brooklyn and is mounting a re match with Republican Rep. Nicole Mal liotakis, who knocked him out of office in 2020. Rose has always leaned on his ex perience as a combat veteran in Afghani stan, where he earned a Purple Heart and Bronze Star. He more recently deployed with the National Guard in 2020 to assist in COVID-19 response.

From West Point cadet to Army combat veteran, Democratic Rep. Pat Ryan’s mil itary experience has been front and center in his campaign. But while Ryan’s service may have distinguished him from Republi can Marc Molinaro in this summer’s spe cial election for the 19th Congressional District, he can’t say the same about his current opponent in the 18th District.

(18TH DISTRICT, REPUBLICAN)

Republican Assembly Member Colin Schmitt is locked in one of the most com petitive races in the state against Ryan in this purple Hudson Valley district. Schmitt is currently a sergeant in the Army National Guard and was activated to work on COVID-19 relief in 2020.

One of the state’s other more competitive races also features two candidates with a military background, and while some ex perts said that military service can help a candidate stick out, it may prove to be a wash in this instance. Republican Brandon Williams served in the Navy, first volun teering as a nuclear submarine officer, ac cording to his campaign website.

WHAT’S HAPPENING: It’s a 2020 rematch – under different circumstances. The prognosticators think it’s likely to stay Republican, after Nicole Malliotakis avoided redistricting doomsday in the first round of lines. In fact, Max Rose almost didn’t bother running. But you can’t entirely write off the feisty Democrat, who won the district in 2018, before it flipped back to the GOP two years later. Rose isn’t getting any support from the Democratic Congressional Campaign Committee or super PACs, but his fundraising has more or less kept up with Malliotakis’, and both had about $1.5 million on hand a month out from the election.

WHAT’S HAPPENING: Coming out of a chaotic redistricting process, Rep. Sean Patrick Maloney’s decision to step into Rep. Mondaire Jones’ district led Jones to run in the crowded 10th Congressional District Democratic primary, which he ultimately lost. Although he received backlash from progressive Democrats, the controversial move by Maloney didn’t stop him from soundly defeating state Sen. Alessandra Biaggi. Now Maloney will face Republican Assembly Member Mike Lawler, who has focused much of his campaign on crime and inflation. Meanwhile, Maloney has prioritized gun safety and abortion rights. As of the end of September, Maloney had nearly $1 million in cash on hand, while Lawler had about $289,000.

18TH CONGRESSIONAL DISTRICT

MID-HUDSON VALLEY

WHAT’S HAPPENING: Rep. Pat Ryan recently secured a win in the August special election race for the 19th Congressional District – a race that many regarded as a bellwether for the midterm elections. Now Ryan will face Republican Assembly Member Colin Schmitt for the seat currently held by Rep. Sean Patrick Maloney, who decided to run in the 17th District. Ryan focused on abortion rights, following the U.S. Supreme Court’s decision to overturn Roe v. Wade, as a pillar of his special election campaign, and he’s running the same playbook in the general election. Meanwhile, Schmitt has focused on opposing critical race theory while attempting to flip the abortion rights issue against Ryan with an ad alleging that Ryan supports late-term abortions. Heading into the election, both candidates have an equal amount of cash on hand –about $550,000 for Ryan and $486,000 for Schmitt.

WHAT’S HAPPENING: After losing an August special election to Pat Ryan, Republican Dutchess County Executive Marc Molinaro finds himself locked in a tight battle for the 19th District against Democrat Josh Riley, a lawyer, former political staffer and first-time candidate. At first, Molinaro appeared to be the favorite to win the seat. He’s a moderate Republican popular in his county and has some statewide recognition after his 2018 run for governor. Even though he doesn’t technically live in the new district, which also no longer includes any part of Dutchess County, conventional wisdom gave Molinaro a leg up over a newcomer like Riley. But a lot has changed since Molinaro first announced he would challenge Antonio Delgado, who resigned to become the lieutenant governor, not least of which was Molinaro’s special election loss. Now, polling has Riley in the lead, with the gap increasing to a more comfortable margin in the past two months. Riley has raised nearly $1 million more than Molinaro and has more than $1.1 million in cash on hand, as of late September, compared to Molinaro’s $400,000.

22ND CONGRESSIONAL DISTRICT

CENTRAL NEW YORK

CURRENT MEMBER: Claudia Tenney (R), who is running in the 24th District

WHAT’S HAPPENING: The 22nd Congressional District is among the most competitive races in the state – rated as a toss-up by Cook Political Report and Politico, while FiveThirtyEight has the Central New York seat leaning Republican. Democratic Iraq War veteran and defense policy adviser Francis Conole and Republican U.S. Navy veteran and tech entrepreneur Brandon Williams are both relatively fresh faces in New York politics. Conole ran in the 24th Congressional District in 2020 but lost by a large margin in the Democratic primary, and Williams only moved to Central New York in 2010. Parts of this new district have repeatedly elected moderate Republican Rep. John Katko over the past decade. Conole is trying to paint Williams as a MAGA Republican, but it’s unclear whether that strategy will stick with voters in this purple district. A Spectrum News/ Siena College poll conducted in late September had Williams with a 45% to 40% lead. Although Conole has outraised Williams and had $527,000 on hand to Williams’ $275,000 as of the end of September, both candidates have benefited from more than $3 million in combined spending by outside groups.

22ND CONGRESSIONAL DISTRICT

TOO CLOSE TO CALL

NEW YORK’S NEWLY drawn 22nd Congressional District hosts one of the most competitive races in the upcoming midterm elections – one of several in the state that could de termine whether Democrats or Republi cans hold power in the House next year.

But in this Central New York hot seat, which includes areas previously represented by moderate Republican Rep. John Katko (in the 24th District) and the farther right Re publican Rep. Claudia Tenney (in the 22nd District), both candidates running this year are somehow still flying under the radar.

A Spectrum News/Siena College poll conducted in late September – one of the only independent polls in the race so far –found that 55% of respondents had no opin ion of Democrat Francis Conole, and 62% had no opinion of Republican Brandon Wil liams. (That poll had Williams with a 45% to 40% lead over Conole, albeit with a mar gin of error of 5.1 percentage points.)

The lack of widespread name recogni tion for both candidates a little over a month ahead of the Nov. 8 election shown in that one poll was not entirely surprising. Conole, a defense policy adviser born and raised in Onondaga County, served on the county committee but has never held major elect ed office. Conole was bested by progres sive Dana Balter in a 2020 primary run in the 24th Congressional District, and in this year’s Democratic primary for the new 22nd District, Conole clinched victory with fewer than 1,000 votes over Sarah Klee Hood.

Williams is even more of a newcomer. The tech entrepreneur and Texas native pulled off an upset victory in the Republi can primary over party-backed Steve Wells with less money in his campaign chest than Wells, and significantly less than Conole had raised at that point. Williams is a firsttime candidate who moved to Central New York in 2010, according to his campaign website. Both Williams and Conole have a military background – Williams is a Navy veteran and Conole is still a commander in the Navy Reserves – and while military ex perience can help distinguish candidates, some experts said it might prove to be a wash in this case.

While name recognition is important in any election, Grant Reeher, director of the Campbell Public Affairs Institute at Syracuse University, predicted that a lack of name recognition with Williams and Conole wouldn’t have a major effect on turnout in the general election, which is typically strong in the area. And there are advantages to being a newcomer, perhaps in particular for Williams. “There is some benefit being a political outsider, and I think the Williams campaign has certainly sought to accentuate that,” said Luke Perry, a polit ical science professor at Utica University. “It makes sense, given the Democrats control the federal government and the state gov ernment, so they’re trying to appeal to peo ple who think the system isn’t working, and you need somebody from the outside to get in there and shake things up.”

Still, the candidates’ short political ca reers only contribute to the race being a difficult one to predict. Following the re districting of congressional seats earli er this year, registered Democratic voters now outnumber Republican voters in the new 22nd District, though not by a large margin. The district now spans Madison County, Oneida County and Onondaga County – and its largely blue city of Syr acuse, which was previously in the 24th District. Despite its recent history of elect ing Republicans to Congress, the district favored President Joe Biden in the 2020 presidential election by roughly 7 percent age points, according to the CUNY Center for Urban Research’s Redistricting & You website. Independent polling in the dis trict, where more than three-quarters of the population is white, has been minimal.

The obvious playbook for the out-ofpower party in a midterm election – Re publicans running on President Joe Biden’s relatively low approval rating and casting the Democratic-led government as fail ing – has been complicated somewhat by landmark decisions by the conserva tive-led U.S. Supreme Court that have energized Democrats, including in the Hudson Valley’s tight special election in August. “In a midterm election, where the Democrats have the White House, both houses of Congress, the governor’s man sion and both houses of state Legislature, his job should be easy,” Democratic strat egist Evan Stavisky said of Williams. “It’s

made more difficult by the fact that the Republicans on the Supreme Court struck down Roe v. Wade, the Republicans on the Supreme Court struck down New York’s gun laws and the leader of his party tried to launch a violent insurrection to overthrow the government.”

Conole is leaning hard into characterizing Williams as a supporter of former President Donald Trump and a “MAGA Republican.” That characterization draws a contrast to Katko, a moderate Republican who voted for Trump’s second impeachment, who has represented Onondaga County since 2015 and who, incidentally, is not endorsing ei ther candidate in the general election. “He’s spent more time attacking Republicans in his own party,” Conole told City & State of Williams. “He is somebody who openly and proudly supports Donald Trump and comes from this MAGA wing of the Republican Party.” Williams’ campaign did not re spond to multiple requests for an interview or comment.

Though Williams has in fact been a vocal supporter of Trump and is on record as criticizing Katko as not being conserva tive enough, he has backed away from some of the more extreme views of that wing of the party. Williams has emphasized that he accepts Biden as the “duly elected presi dent” – a position a majority of Republican candidates across the country disagreed with. He has also updated some of the lan guage on his campaign website since the primary election to highlight exceptions to his hardline position against abortion in instances where incest or rape is involved, or the mother’s life is at risk. Williams has said he would vote against a federal bill that would ban abortions after 15 weeks if he were elected to Congress.

“When you watch his ads, and you listen to him speak, he really does not lead with more of the Tea Party message or a Trump loyalist message,” Reeher said. “He sounds very much more like a mainstream Repub lican, even though if you try to pin him down on some of his policy positions, he’s quite conservative.”

Conole targeted his first television ad on Williams’ opposition to abortion access –a strategy that paid off for newly elected Democratic Rep. Pat Ryan in the special election in the 19th Congressional District in August. “We’re hearing both econom ic challenges, but also very real concerns about some of the foundational freedoms at risk,” Conole said, mentioning reproduc tive rights in particular, when asked what he thinks voters in his district care most about.

25TH CONGRESSIONAL DISTRICT

WHAT’S HAPPENING: Few expect Rep. Joseph Morelle to lose his solid blue seat, but a challenge from La’Ron Singletary has garnered some attention. The former Rochester Police Department chief came under scrutiny following the 2020 police killing of Daniel Prude, which sparked protests across the city. After evidence emerged of an alleged cover-up of the circumstances surrounding Prude’s death, Singletary announced his resignation, although then-Rochester Mayor Lovely Warren fired him before his resignation took effect. After that, he decided to launch a long-shot bid to unseat Morelle, who has held the seat since 2018 and wields significant power in Monroe County. Morelle has raised nearly $1.8 million and had less than $700,000 on hand as of late September, while Singletary has raised $541,000 and has less than $100,000 on hand.

Who’s running for a newly drawn state Senate?

THE 2020 ELECTIONS left Dem ocrats with a historic superma jority in the state Senate and a strong progressive contingent. Forty-four new members joined the state Legislature, and they made the chamber the most di verse in state history. The GOP-dominat ed chamber of just six years ago now feels even more distant. The continued momen tum for state Senate Democrats is visible in their fundraising: The Democratic Senate Campaign Committee has over $3 million on hand, while Republicans have a little under $1 million as of October.

This summer, multiple Democrat ic incumbents survived fierce prima ry challenges from the right and the left. Democratic state Sen. Kevin Parker bested Democratic Socialists of America-backed David Alexis in Brooklyn, and progres sive state Sen. Gustavo Rivera defended his seat against Bronx machine-backed attor ney Miguelina Camilo. He wasn’t the only state Senate progressive to defeat centrist challenges, some of whom were endorsed by New York City Mayor Eric Adams. Adams already had a less-than-friendly re lationship with progressive state lawmak ers because of different perspectives on issues such as bail reform.

In this election, Republicans are los ing their favorable maps drawn in 2010. During the chaotic redistricting process, the state Court of Appeals invalidated the state Senate and congressional maps pro posed by the Democratic-controlled Leg islature. Lawmakers are now running in newly drawn districts made by the court-appointed special master. The out come was better for Republicans than the Democrats’ maps, but they’re still losing a gerrymandered advantage in many cases

from the 2010 redistricting process, turn ing many of their safe seats competitive.

State Sen. Pamela Helming, chair of the state Senate Republican Campaign Com mittee, told City & State her party is seek ing to even the playing field. “If there’s anything that I hear from people all across the state, regardless of which political party they belong to, it’s really to restore some balance to the state,” Helming said.

National issues of the economy, crime and abortion have played a key role in the cam paign efforts of candidates from each party. Republicans have focused on inflation, and a recent Siena College poll showed economic issues were the top concern of 30% of voters polled. When it comes to local issues, sever al Republican candidates have focused their campaigns on public safety and repealing bail reform. Crime has remained a top con cern of many voters on Long Island, where there are several competitive state Senate races, in recent elections.

Democrats have focused on abortion rights following the U.S. Supreme Court’s ruling to overturn Roe v. Wade. Democratic state Senate Campaign Committee Chair Michael Gianaris said voters are realizing state gov ernment is more important than ever before. “The craziness coming out of Washington –with the Supreme Court – has lit a fire under Democrats to turn out and vote. We’re hop ing that it is able to offset some of the histor ical turnout problems that would occur in a midterm,” Gianaris told City & State.

There are multiple competitive state Senate races to keep an eye out for. The elections this year include incumbent ver sus incumbent match-ups, several open seats and efforts by former elected officials to make a political comeback.

DISTRICT 1

ANTHONY PALUMBO (R, INCUMBENT) VS. SKYLER JOHNSON (D)

2020 election: Anthony Palumbo (R) 51.37%, Laura Ahearn (D) 48.63%

Voter registration: 76,850 active Democrats, 68,507 active Republicans

The Long Island state Senate district that served as a Republican stronghold for over 40 years now has Republicans outnum bered by 8,000 Democratic voters thanks to redistricting. First-term state Sen. An thony Palumbo will face a Democratic challenge from nonprofit employee and former Southampton mayoral aide Skyler Johnson. Palumbo was supposed to have a smooth road to reelection, but those plans were upended because of redistrict ing. Johnson previously ran in the Dem ocratic primary for the seat in 2020, the

then-19-year-old using TikTok to get his campaign message out, but ultimately lost to Laura Ahearn, who went on to lose to Palumbo by about 3.5 points. Now that he has secured the Democratic nomination this time around after avoiding a prima ry, Johnson likely won’t go down without a fight. With $25,000 in cash on hand as of October, he’ll have to fight tooth and nail to compete against Palumbo’s incum bency and close to $40,000 in campaign funds. As a member of the Investigations and Government Operations Committee, Palumbo has called for a legislative inves tigation into Gov. Kathy Hochul’s con tracting practices following the Times Union’s reporting on the state’s $637 mil lion contract to buy COVID-19 home tests from a major Hochul donor. Palumbo has been vocal about his opposition to bail re form, and his GOP state Senate colleagues sounded the alarm when two bills aimed at sealing certain criminal records advanced in the state Senate. Johnson has priori tized reproductive rights, climate change infrastructure, education and health care throughout his campaign. He has secured endorsements from several influential New York politicians, including U.S. Sen ate Majority Leader Chuck Schumer, state Comptroller Tom DiNapoli and state Sen ate Deputy Majority Leader Michael Gi anaris.

Mattera won a decisive victory in 2020 over Democratic opponent Michael Sider akis in the open race for the district. Now Mattera will face former Suffolk County Legislature Majority Leader Susan Berland, who has spent 20 years in local elected of fice. District 2 has been pretty dramatical ly redrawn, and in the process has become a lot more purple. While incumbency and the voting patterns of the district may be on his side, Mattera has his work cut out for him. Berland has staked her campaign on reproductive rights, the economy and pub lic safety. Mattera has positioned himself

Republican state Sen. Phil Boyle isn’t seeking reelection, leaving his seat up for grabs. The demographics of District 4 have shifted dra matically with redistricting, transforming it from a district that slightly favored Trump in 2020 to one that is decidedly Democratic. Hispanic voters now make up about 40% of the district – double the percentage of His panic voters in the previous district. After losing her reelection for District 3 in 2020 to GOP challenger Alexis Weik, Democrat and former state Sen. Monica Martinez is at tempting to make her comeback against Re publican businessperson Wendy Rodriguez. During her single term in the state Senate, Martinez prioritized women’s health is sues, animal rights, health care and climate action. She bested Assembly Member Phil Ramos in the August primary election – se curing 65% of the vote. Many political ex perts who spoke to City & State agree that Martinez is the odds-on favorite in this elec tion. With over $80,000 on hand in cam paign funds as of early October, Martinez also has an edge over Rodriguez’s war chest of $29,000. The Democratic Senate Cam paign Committee has spent $32,000 to sup port Martinez, while the Senate Republican Campaign Committee has spent nothing on Rodriguez.

After the redistricting process made the 8th District favorable for Republicans, state Sen. John Brooks announced his retirement. Then just a few weeks later, Brooks an nounced he would in fact run for reelection – but in the drastically newly drawn 5th Dis trict. This district undoubtedly gave Brooks a better shot at winning reelection compared to the new District 8, but the incumbent will still face a fierce challenge. The redrawn dis trict now has a slight majority of voters who supported Trump in 2020 compared to the old district, which favored Biden. How ever, Republicans seem more invested in the race, with the Senate Republican Campaign Committee having spent nearly $75,000 on Rhoads, while the Democratic Senate Cam paign Committee has spent only $29,500 on Brooks.

Voters in the 7th state Senate District will be choosing between their incumbent sen ator and a former senator. After successful ly beating former Port Washington Police Commissioner David Franklin in 2020, state Sen. Anna Kaplan focused her time in the state Senate on legislation aimed at gun violence prevention, Holocaust education and abortion rights. Kaplan must now face an even tougher Republican challenger: Jack Martins, who represented the district from 2011 through 2016 and also served as Mineola mayor. Kaplan has the advantag es of incumbency and voter enrollment, as well as fundraising, but political experts said this may be the race to keep an eye out for. Martins has a formidable amount of name recognition. Recently, he has tout

ed the endorsement of the Police Conference of New York and has vowed to repeal bail reform, a key issue that led to a red wave on Long Island in 2021. Both candidates have a healthy amount of cam paign funds on hand before the election, $264,000 for Kaplan and $173,000 for Martins. The Demo cratic Senate Campaign Commit tee is spending big to help keep Kaplan in her seat, investing over $160,000 on her campaign, while the Senate Republican Campaign Committee is using a significant chunk of its more limited cash by infusing about $70,000 into the race for Martins

This is an open race for the seat held by Democratic former state Sen. Todd Ka minsky, who represented the district for eight years and resigned to work at a lob bying firm. Kaminsky flipped the seat blue in 2016 after Republican former state Senate Majority Leader Dean Skelos was convicted on federal corruption charges. Democratic candidate Kenneth Moore, mayor of Bellerose Village on Long Island and a volunteer firefighter, has focused much of his campaign on taxes, public safety and climate action. The Republi can candidate Patricia Canzoneri-Fitz patrick has been critical of Kaminsky’s support of bail reform and has made crime the cornerstone of her campaign. Heading into the election, Moore has $76,000 on hand, and Canzoneri-Fitzpatrick has just

over $38,000. In terms of voter registra tion, Democrats have kept a hold on this district before and after redistricting. The district voted for Biden during the 2020 election and the new district has Demo crats with a great voter advantage over Republicans. Democrats have not spent any money to support Moore in the race, while Republicans have spent just over $96,000, the most of any candidate, in order to help Canzoneri-Fitzpatrick flip the seat.

Coming out of a narrow victory in 2020, first-term state Sen. Elijah Reichlin-Mel nick will face a rematch against William Weber in the Lower Hudson Valley dis trict. The Republican challenger held a narrow lead on Election Day in 2020, but the counting of absentee ballots ultimate ly led to a victory for Reichlin-Melnick. Since then, the senator has prioritized ed ucation funding, gun violence and health care while in the state Senate. Weber, who has focused much of his campaign on pub lic safety and repealing bail reform, may have a better chance of winning the dis trict this time around because of redis tricting. In the new district lines, the share of voters who supported Biden in 2020 shrank. Nonetheless, Weber will need to compete against Reichlin-Mel nick’s incumbency and pockets. Heading into the election, Reichlin-Melnick has about double the amount of cash on hand that Weber has – $191,000 for Reich lin-Melnick and $89,000 for Weber. After state Sen. James Skoufis found him self redistricted into the newly drawn Dis trict 42, his seat opened up in Hudson Valley’s District 39. Skoufis has endorsed Democratic nominee Julie Shiroishi in this race against Republican opponent Robert Rolison. Shiroishi, who is the chair of the Dutchess County Democratic Committee, joined the political world after a career in publishing and then raising kids, work ing as chief of staff in 2019 for Assembly Member Jonathan Jacobson. Her campaign has centered around the economy, climate change, abortion rights and education. The voting patterns of the district, mainly due to redistricting, have made for a like ly favorable outcome for Shiroishi. Rolison, who’s serving his second term as mayor of Poughkeepsie, has centered his campaign around his work fixing the city’s economic issues. Rolison has name recognition, but he has come under fire for the city’s sig nificant financial stress in 2021 following a report by state Comptroller Tom DiNap oli. Both candidates have about the same amount in campaign funds on hand as of October, Shiroishi with $81,000 and Roli son with $84,000.

Voter registration: 85,954 active Democrats, 58,950 active Republicans

These two state senators find themselves in the unique position of running against a fellow sitting senator after the new state Senate map placed them both in the same district. Republican state Sen. Sue Seri no will face first-term Democratic state Sen. Michelle Hinchey, who currently represents the 46th District. The pair of mid-Hudson Valley legislators have even worked together during their overlapping time in the state Senate, co-sponsoring a bill that directed New York’s commis sioner of agriculture and markets to cre ate a public awareness campaign about Lyme disease and other tick-borne illness es that Gov. Kathy Hochul signed into law last year. Abortion rights are a hot-button issue in this race. In the aftermath of the

U.S. Supreme Court’s decision to overturn Roe v. Wade, Hinchey sponsored legis lation to protect health care workers and abortion rights in the state; Serino later voted against the bill once it was brought to the state Senate floor. In the most re cent campaign disclosure from October, Hinchey had a $370,000 war chest and Serino had a little over $247,000. Demo crats seem intent on Hinchey holding her seat, with the Democratic Senate Cam paign Committee having transferred near ly $300,000 directly into her campaign account, the most the committee has spent on a single candidate so far this year. The Senate Republican Campaign Committee has spent about $47,000 for Serino.

After deciding against a con gressional bid to clear the field for Rep. Pat Ryan, state Sen. James Skoufis decided he’d launch his reelection in the newly drawn 42nd District. He avoided a matchup with state Sen. Mike Martucci, who currently represents the district, after the Republican decided not to run for reelec tion. A GOP vacancy commit tee chose Republican Monroe Town Council Member Dorey Houle to run against Skou fis. Houle conceded that this race is an “uphill battle,” but remains optimistic heading into the election. Skoufis has an eye-popping $1 million in campaign funds, while Houle has just a little over $28,000 heading into the election. Political experts who spoke with City & State agree this will be a tight race and will be indicative of how each party is doing as a whole in New York state.

Voter registration: 72,095 active Democrats, 51,709 active Republicans

This is an open race for the seat currently held by state Sen. Daphne Jordan, who de cided to run for reelection in District 44 be cause of redistricting – then later dropped out of the race ahead of the Republican pri mary. Assembly Member Jake Ashby will face Democrat Andrea Smyth for the dis trict where there are now 20,000 more en rolled Democrats than Republicans, and where nearly 60,000 independent voters live

as well. Smyth, who’s president and CEO of the New York State Coalition for Children’s Behavioral Health, has largely self-fund ed her campaign, lending herself $100,000 with her husband, Ron Massaroni. She ran for Rensselaer County executive in 2017, los ing to Republican Steve McLaughlin. Ashby, a veteran, has the advantage of representing Assembly District 107 which overlaps with District 43. Heading into the election, Ashby has about $55,000 cash on hand while Smyth has $80,000. Although Democrats have not spent on the race, the Senate Re publican Campaign Committee has invested a little under $36,000 to support Ashby.

Voter registration: 74,224 active Democrats, 69,865 active Republicans

This open race for a district just north of Albany is also a rematch. In 2018, incum bent Republican state Sen. James Tedisco was faced by Democratic challenger Mi chelle Ostrelich but ultimately defended his seat by 19 points in a district that went on to favor Biden in 2020. In 2018, which was a good year for Democrats, Ostrelich narrow ly carried the parts of the district that were in Schenectady County, but Tedisco cleaned up in the parts of the district in suburban and rural Saratoga County. Both areas par tially overlap with the new District 44. This time around, Ostrelich, a Schenectady County legislator, has positioned herself as a Democrat who’s campaigning on reproduc tive rights issues as well as voting rights and climate change. Ostrelich may have a better chance this time around since Democrats have an edge over Republicans in this newly drawn district, but nearly 60,000 indepen

dent voters have a way of making things less predictable. Ostrelich will likely have a hard time going up against the name recognition of Tedisco, who has served in the state Leg islature for almost three decades. Tedisco currently represents District 49 and decided to run in this district after redistricting. As of October, Tedisco has about $118,406 in cash on hand while Ostrelich has $61,000.

LEA WEBB (D) VS. RICHARD DAVID (R)

2020 election: Fred Akshar (R) 87.44%, Thomas Quiter (L) 12.56%

Voter registration: 77,186 active Democrats, 51,658 active Republicans

District 52 changed dramatically during re districting, shifting north from the Southern Tier into Cortland and Tompkins counties and becoming much bluer. Former Bing hamton City Council Member Lea Webb has focused much of her political career on cli mate change, fair housing and health care. Webb had an easy primary win against Les lie Danks Burke, securing 60% of the vote and all three counties of the district: Broome, Cortland and Tompkins. Webb will now face Republican Binghamton Mayor Rich ard David, who has focused his campaign on crime, bail reform and inflation. Although the new district still spans a lot of those Re publican areas from the old district, Demo crats now outnumber Republicans by over 25,000 registered voters. Webb has the en rollment advantage, but David has the fund raising advantage. David has about $79,000 in cash on hand heading into the election, while Webb has $68,000. Democrats have spent just under $40,000 to support Webb, while Republicans haven’t spent on the race.

End All Shapes and Sizes of Discrimination

In the Big Apple, it’s still often legal to discriminate against people due to their weight or their height. That’s why the RWDSU, and a coalition of community and advocacy groups, is supporting an amendment to New York City’s administrative code that would ban New Yorkers from discrimination based upon height and weight. It’s an important issue; height and weight discrimination runs rampant and unchecked in many industries in New York, and it often goes hand-in-hand with racial discrimination and bias against women. Addressing height and weight discrimination with this legislation [Intro 02092022] is an important step toward fighting societal problems such as sexism, racism, and economic inequality.

This discrimination is prevalent in the fashion retail industry. Workers who are not protected by a union have no recourse against a boss who wants to discriminate against someone due to body size, and RWDSU representatives hear about it when they organize in these workplaces. Workers at

some fast fashion stores have reported being forced to diet or risk being fired, with some even required to send full-body photos to executives for review. Workers in the industry have reported that management will only hire “skinny, white, and pretty” employees to work on their sales floors.

This bill would protect countless New Yorkers from this type of blatant, often systemic discrimination. It will help workers who can’t get a job, or who suffer from lack of promotion at work based upon not their performance, but their appearance. It will protect people who are seeking public housing or other public accommodations avoid being affected by discrimination. Businesses would still be able to receive waivers for “reasonable” exceptions or legitimate health and safety issues, creating a fairer playing field while still ensuring employers can operate appropriately and safely.

Height and weight discrimination is intertwined with social injustice and racial discrimination. Studies show that people of color in the U.S. — Black and Hispanics — are more likely

to be of a higher weight than white people. Black Americans are likely to be on average one inch shorter than white Americans, and Asian and Hispanic Americans average about three inches shorter in height than their Caucasian counterparts. Women in America are more likely than men to be considered obese, and studies show that women are more likely to be discriminated against than men due to their appearance.

Discrimination based upon appearance and size hits New Yorkers right in their wallets, hurts our communities, and hurts families. A study on the issue showed that larger workers earn lower wages and are more likely to be viewed negatively by hiring managers. Larger peoples’ performance is more likely to be viewed negatively by supervisors; with “weight bias” hurting workers’ overall compensation, performance evaluations, and even quality of training.

As a society, and in our workplaces, discrimination due to appearance is sadly all too prevalent.

Every single New Yorker deserves the right to a workplace and employment landscape free of prejudice and discrimination, and every industry in New York needs to recognize that good workers come in all shapes and sizes. Passing Intro 0209-2022 is how we can make this happen.

Get out and vote! No wait – not you. It’s a little known (untrue) fact that the New York City Board of Elections also oversees City & State’s weekly vote for the biggest political Winners & Losers. And seems that Republican Commissioner Fred Umane has raised a concern – there are simply too many people in Democratic-dominated New York City who vote in the poll. So please – North Country bumpkins, Southern Tierians, Long Island Baymen – hear our call and vote as well.

Recent polling must be music to Rep. Lee Zeldin’s ears. Public polling that predicted his landslide defeat just a month or two ago has now narrowed to as little as 4 percentage points. Another new survey found the gap only slightly wider at 6 percentage points. Gov. Kathy Hochul might be getting a little nervous now that her big lead seems to be dwindling.
